PREAMBLE
These General Terms and Conditions of Sale and Use (hereinafter "T&Cs") govern all contractual relationships between Fast Parts BV (hereinafter "the Seller") and any purchaser (hereinafter "the Customer") making a purchase via the website https://fastparts.be.

By placing an order on the Website, the Customer unconditionally accepts these T&Cs in the version in force on the date of the order. They take precedence over all other documents of the Customer, unless otherwise agreed in writing.
ARTICLE 1 — Scope of Application
1.1 The Seller markets particulate filters, turbochargers, injectors, and related automotive parts (new, reconditioned, or second-hand as specified in the product listings) to private individuals (B2C) and professionals (B2B) established in the European Union.
1.2 For professional customers, these T&Cs apply in full unless a framework agreement signed by both parties expressly derogates from them. The Customer's general purchasing conditions apply only if expressly accepted in writing by the Seller.
1.3 Each professional Customer undertakes, upon registration, to provide a valid intra-community VAT number. The Customer is solely responsible for the accuracy of the information provided.
ARTICLE 2 — Products and Compatibility
2.1 Products are described as accurately as possible. Photographs, illustrations, and technical data are provided for guidance purposes only.
2.2 It is the Customer's responsibility to verify the OEM compatibility of the product (reference, engine type, year, emission standard) before placing an order. The Seller disclaims all liability for ordering errors attributable to the Customer.
2.3 Quotations are valid for 14 calendar days from the date of issue.
2.4 In the event of product unavailability after order confirmation, the Seller will notify the Customer as soon as possible and offer either an equivalent product or a full refund.
ARTICLE 3 — Prices
3.1 Prices are expressed in euros (EUR), inclusive of all taxes (VAT incl.) for private individuals and exclusive of VAT for professionals. Belgian VAT at 21% applies, or the applicable rate of the country of delivery under the OSS scheme for intra-EU deliveries to consumers.
3.2 Delivery charges are indicated separately before the final confirmation of the order.
3.3 The Seller reserves the right to modify prices at any time. Products are invoiced at the rates in force at the time of order confirmation.
ARTICLE 4 — Order and Contract Formation
4.1 Orders are placed via the Website through a multi-step process: consultation of the product listing, selection, entry of delivery and billing information, choice of payment method, final confirmation.
4.2 An order confirmation email is automatically sent to the Customer. It constitutes an acknowledgement of receipt but not a definitive acceptance.
4.3 The contract of sale is definitively formed upon dispatch by the Seller of a shipping confirmation or a product availability confirmation email.
4.4 The Seller reserves the right to cancel any order in the event of suspected fraud, a manifest pricing error, or product unavailability, with a full refund where applicable.
4.5 Orders for specially ordered parts (outside standard stock) are firm upon confirmation and may incur cancellation charges.
ARTICLE 5 — Payment
5.1 Payment is made at the time of ordering by one of the following methods:
• Credit/debit card (Visa, Mastercard, etc.) via the secure Mollie platform,
• PayPal,
• Bank transfer (order processed upon receipt of confirmed transfer).
5.2 All transactions are secured by SSL/TLS encryption. The Seller does not retain any complete banking data of the Customer.
5.3 For bank transfer payments, the Customer has 7 working days to complete the transfer from the date of order. After this period, the order is automatically cancelled.
5.4 For professional customers with an open account, deferred payment terms may be agreed under a separate written agreement. Absent such an agreement, invoices are payable in cash upon delivery.
5.5 Any late payment automatically and without prior notice entails: (i) late payment interest at the applicable Belgian statutory rate; (ii) a fixed recovery indemnity of EUR 140 VAT inclusive per unpaid invoice. The Seller reserves the right to suspend all current deliveries until full payment of all outstanding amounts.
ARTICLE 6 — Delivery
6.1 Deliveries are made via DHL, DPD, and/or Bpost, to Member States of the European Union. Delivery times are indicative and run from the shipping confirmation.
6.2 Risk passes upon handover of the goods to the Customer or to the Customer's designated carrier. The Customer undertakes to take delivery of the goods at the agreed time.
6.3 Mandatory check upon receipt: any complaint regarding quantities, apparent defects, or visible damage must be submitted in writing to info@fastparts.be within 3 calendar days of receipt. Precise reservations must also be made with the carrier on the delivery note. After this period, the goods are deemed definitively accepted.
6.4 In the event of non-delivery within 30 calendar days of the order date (excluding force majeure), the Customer may terminate the contract and obtain a full refund.
ARTICLE 7 — Right of Withdrawal (B2C only)
7.1 In accordance with Directive 2011/83/EU and Book VI of the Belgian Code of Economic Law, the private Customer has 14 calendar days from physical receipt of the goods to exercise their right of withdrawal, without having to give reasons.
7.2 Withdrawal must be notified by email to info@fastparts.be or by registered letter with acknowledgement of receipt. A model withdrawal form is available on the Website.
7.3 The product must be returned unused, unmounted, complete and in its original packaging within 14 days of notification. Return costs are borne by the Customer, except where the error is attributable to the Seller.
7.4 Reimbursement is made within 14 days of receipt of the return or proof of dispatch, using the same payment method as that used for the original order.
7.5 The right of withdrawal does not apply to specially ordered parts, or to unsealed products that cannot be returned for reasons of health, safety, or hygiene.
ARTICLE 8 — Returns (Outside Withdrawal Period)
8.1 Any return outside the statutory withdrawal period is subject to prior written agreement from the Seller. No return will be accepted without this agreement.
8.2 Returned parts must be unused, unmounted, and complete in their original packaging.
8.3 Mounted, damaged, or used parts will not be accepted.
8.4 Return costs are borne by the Customer, unless the error is attributable to the Seller.
ARTICLE 9 — Warranties
9.1 Commercial warranty: Fast Parts BV grants a 1-year warranty from the date of purchase against manufacturing defects identified by its services. The remedy is limited to repair or replacement of the part recognised as defective. The warranty covers the part exclusively, to the exclusion of all labour costs, installation/removal costs, vehicle downtime, or related costs.
9.2 Statutory conformity warranty (B2C): the consumer benefits from the statutory conformity warranty in accordance with Directive (EU) 2019/771. The commercial warranty applies without prejudice to these mandatory statutory rights.
9.3 Statutory warranty against hidden defects: the Seller is liable for hidden defects rendering the goods unfit for their intended use, in accordance with Articles 1641 et seq. of the Belgian Civil Code.
9.4 Traceability: all products are subject to traceability (serial number, warranty date). Any removal or alteration immediately results in the loss of warranty and refusal of the return.
9.5 Warranty exclusions: normal wear, incorrect or non-compliant installation, improper use, poor maintenance, damage caused by another component, unauthorised modifications. The part must be returned for expert assessment before any decision is taken.
ARTICLE 10 — Seller's Liability
10.1 The Seller's liability may only be engaged in the event of proven fault in the performance of the contract.
10.2 The Seller's total liability to a professional Customer is capped at the VAT-inclusive amount of the order concerned.
10.3 The Seller shall not be liable for indirect damages such as loss of business, turnover, profits, or vehicle downtime.
10.4 These limitations do not apply to personal injury, fraud, or gross negligence, nor to consumers' mandatory statutory rights.
ARTICLE 11 — Retention of Title
Title to the goods sold remains with the Seller until full payment of the price including all costs and taxes. In the event of non-payment, the Seller may demand the return of the goods. The Customer authorises the Seller to access the premises for this purpose. Risk passes upon delivery.
ARTICLE 12 — Force Majeure
The Seller shall not be liable for any delay or failure to perform resulting from a force majeure event: strike, fire, breakdown, stock shortage, transport disruption, government measures, pandemic, or similar event beyond the Seller's control. In the event of a lasting impossibility (more than 30 days), either party may terminate the contract without compensation, with reimbursement of amounts paid.
ARTICLE 13 — International Sales within the EU
These T&Cs apply to all sales made within the EU. For intra-community deliveries, VAT is applied in accordance with the OSS rules. Professional customers registered for VAT in another Member State benefit from reverse charge subject to provision of a valid VAT number. The Customer bears any formalities, taxes, or import duties applicable outside the EU regime.
ARTICLE 14 — Personal Data Protection
The processing of Customers' personal data is governed by the Privacy Policy available on the Website, which forms an integral part of these T&Cs.
ARTICLE 15 — Intellectual Property
All content on the Website is protected by Belgian intellectual property law. Any unauthorised reproduction, distribution, or exploitation is strictly prohibited.
ARTICLE 16 — Dispute Resolution
16.1 In the event of a dispute, the Customer is invited to first contact the Seller's customer service at info@fastparts.be to seek an amicable resolution.
16.2 For consumers (B2C): if an amicable resolution fails, the Customer may refer the matter to the Consumer Mediation Service (CMS) — Bd du Roi Albert II, 8 bte 1, 1000 Brussels — www.mediationconsommateur.be. The European online dispute resolution platform is accessible at: https://ec.europa.eu/consumers/odr.
16.3 For professionals (B2B): any dispute shall fall under the exclusive jurisdiction of the courts of the judicial district of Gand (Gent).
16.4 These T&Cs are governed by Belgian law. The Vienna Convention on the International Sale of Goods (CISG) is expressly excluded for B2B relationships.
ARTICLE 17 — Final Provisions
17.1 If any clause is declared null and void or unenforceable, the remaining clauses remain in force. A valid clause pursuing the same objective shall be substituted.
17.2 The Seller's failure to invoke a breach shall not constitute a definitive waiver of the right to do so.
17.3 The Seller reserves the right to amend these T&Cs at any time. Amendments take effect upon publication. Prior orders remain governed by the version in force at the time of their confirmation.
